RELEASE OF LIABILITY (FL)
WAIVER AND RELEASE OF LIABILITY
This Waiver and Release of Liability (the “Agreement”) is executed on this ___ day of ____________, 2025, by the undersigned (the “Participant”), in favor of Next Generation Handball, LLC, its members, affiliates, officers, directors, agents, employees, volunteers, sponsors, partners, and all other individuals or entities acting on its behalf (collectively referred to as the “Released Parties”).
1. Assumption of Risk
The Participant understands and acknowledges that participation in handball-related activities, including but not limited to practices, games, events, tournaments, and training sessions (the “Activity”) involves inherent risks of injury, including but not limited to, physical injury, strain, sprains, broken bones, concussions, or other serious physical harm. The Participant voluntarily assumes all such risks associated with the Activity.
2. Waiver and Release
In consideration of being allowed to participate in the Activity, the Participant, for themselves, their heirs, personal representatives, and assigns, hereby fully and irrevocably waives, releases, and discharges the Released Parties from any and all claims, demands, actions, suits, liabilities, damages, or losses arising out of or in any way connected to the Activity, including but not limited to, those arising from the negligence, recklessness, or intentional conduct of the Released Parties.
3. Indemnification
The Participant agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, actions, suits, liabilities, damages, and losses, including attorneys’ fees and court costs, arising out of or in connection with the Participant’s involvement in the Activity, including but not limited to any injury to the Participant or any other person, or damage to property.
4. Medical Treatment
The Participant acknowledges that the Released Parties are not responsible for providing any medical treatment or insurance coverage. The Participant agrees to assume full responsibility for their own health and well-being and consents to receive medical treatment in the event of injury, accident, or illness during the Activity. The Participant agrees to pay all costs associated with such medical treatment.
5. Photography and Media Release
The Participant grants permission to the Released Parties to take photographs, videos, or other media recordings of the Participant during the Activity. The Participant further grants the Released Parties the right to use, publish, and distribute such media for promotional, educational, or commercial purposes without compensation.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising out of or relating to this Agreement shall be resolved in the courts located in Broward County, Florida, and the Participant consents to the exclusive jurisdiction of such courts.
7. Severability
If any provision of this Agreement is deemed to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.
8. Acknowledgment
The Participant acknowledges that they have read and understood this Agreement, that they are voluntarily signing it, and that they are fully aware of the legal consequences of signing this document, including the waiver of certain rights.
